General Terms and Conditions (GTC)
(This is a translation for convenience purposes only. In case of disputes, the German version shall prevail.)
The terms and conditions apply to all current and future business relationships. Consumers within the meaning of the terms and conditions are natural persons with whom a business relationship is entered into without them being attributed to a commercial or independent professional activity. Entrepreneurs within the meaning of the terms and conditions are natural or legal persons or legally capable partnerships with whom business relationships are entered into who act in the exercise of a commercial or independent professional activity. Customers within the meaning of the business relationships are both consumers and entrepreneurs. The General Terms and Conditions (GTC) apply to all business transactions with our customers, hereinafter referred to as "clients." The GTC are automatically accepted by the client upon placing an order. Deviating, conflicting, or supplementary general terms and conditions do not become part of the contract, even if known, unless their validity is expressly agreed to in writing.
Order Placement
The client can place orders with us in all forms, i.e., by telephone, post, or email. We also accept informal orders. Upon receipt of an order, the client will receive a confirmation of the appointment by email. By contacting us, the client acknowledges the current version of the GTC. The client can find the current version of the GTC on the website www.YourJobCoach.de. These can be objected to in writing within 14 days of becoming known.
Fees and Additional Costs
Fees and charges agreed upon in the contract will be charged for services rendered. Coaching services are generally billed by time hours (1 TH = 60 minutes), language instruction by teaching units (1 TU = 45 minutes). Unless otherwise agreed in the contract, the following fees will be charged additionally to the offer price for the agreed services:
The prices shown are final prices. No value-added tax is levied in accordance with § 19 of the German Value Added Tax Act (UStG) and therefore not shown. Unless costs are guaranteed from another source, the client is considered the debtor of the invoice amount. For group seminars, a prepayment of 25% of the agreed fee is to be made two weeks before the seminar begins.
Invoices are payable immediately upon receipt of the invoice without deduction.
Appointment Cancellation / Interruption / Termination
Coaching: A free cancellation of an appointment is possible up to 24 hours (Online) or 48 hours (In-person) before the agreed-upon appointment, after which the fee becomes due in full. The Coach/Trainer is entitled to offer an alternative appointment in the event of unavoidable hindrance or force majeure, even at short notice. Both sides can terminate the coaching agreement at any time and without giving reasons.
Language Instruction: One teaching unit (TU) consists of 45 minutes. A rescheduling is possible free of charge up to 24 hours before the agreed-upon appointment. Dates canceled by the teacher or student must be made up within 4 weeks. If a student fails to attend a lesson (promptly) or cancels late, it will be charged. Interruption of language instruction is possible for a maximum of four weeks / calendar year. For longer breaks or termination of instruction, a notice period of four weeks to the end of the month applies.
Copyright
Documents handed out to clients, unless otherwise agreed, are included in the agreed compensation. The copyright to the documents belongs solely to the service provider or author. The client is not allowed to reproduce the documents, in whole or in part, or make them accessible to third parties without the written consent of the service provider.
Insurance Coverage
Coaching is not therapy. Normal mental resilience is assumed. The client assumes responsibility for themselves and their actions within and outside of the sessions. Organizers of group coachings, seminars, workshops, etc. are always the clients. Therefore, participants do not have insurance coverage through YourJobCoach.
Liability
The information and advice in coaching sessions as well as in all documentation are carefully considered and reviewed by the Coach. The activities of the company YourJobCoach are purely service-oriented. Therefore, no success is owed. Liability is excluded except for intent and gross negligence. The transmission or electronic transmission of any data is at the client's risk.
Confidentiality
The company undertakes to maintain absolute confidentiality towards third parties regarding all operational, business, and private matters of the client that become known in the course of the activity, even after the termination of the contract. In addition, YourJobCoach undertakes to carefully store and protect from third-party access any documents provided for the purpose of consulting.
Final Provisions
Should individual provisions of the contract with the customer, including these General Terms and Conditions, be or become wholly or partially ineffective, the validity of the remaining provisions shall not be affected. The wholly or partially ineffective provision shall be replaced by a provision that comes as close as possible to achieving the economic success of the ineffective provision.
Place of Performance and Jurisdiction
The place of performance and jurisdiction is Wuppertal. German law shall apply exclusively.
